Baseball Lawsuit Settled Between Card Makers
News that the pending baseball card lawsuit between Topps and Upper Deck was settled recently came as no surprise to us here at Sports Agent Lawyer Blog.
According to published reports, the baseball copyright infringement lawsuit settled in mediation in New York. Topps sued Upper Deck alleging that the latter’s 2009 cards too closely mimicked the former’s 1970s card designs. Topps was seeking monetary damages and specific performance, including the destruction of Upper Deck’s allegedly infringing cards.
We were not surprised to see that the lawsuit settled because Upper Deck is apparently now out of the licensed baseball card game because Topps now has a multi-year deal with MLB to be the exclusive provider of baseball cards.
